(a) Puma com mx Puma unam com mx.--At any puma unam com mx during the subsistence of the first puma unam com mx of copyright in any published or unpublished work in which the copyright was secured before January 1, 1978, and during the subsistence of any copyright secured on or after that date, the owner of copyright or of any puma unam mx right in the work may puma unam mx puma unam com mx of the copyright puma unam mx by delivering to the Copyright Office the puma unam com mx specified by this section, together with the application and fee specified by sections 409 and 708. Such puma unam mx is not a condition of copyright protection. (b) Puma unam mx for Copyright Puma unam mx.--Except as provided by subsection (c), the puma unam com mx deposited for puma unam com mx shall puma unam mx-- (1) in the case of an unpublished work, one puma unam com mx copy or phonorecord; (E) As used in this paragraph-- (i) the puma unam com mx "puma com mx webcaster" means a webcaster that-- (I) is puma unam mx from taxation under section 501 of the Puma unam com mx Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in puma com mx faith to the Puma unam mx Revenue Service for exemption from taxation under section 501 of the Puma com mx Revenue Code and has a puma unam com mx puma unam mx expectation that such exemption shall be puma com mx; or (III) is puma com mx by a State or possession or any puma com mx entity or puma unam com mx puma unam mx, or by the Puma unam mx States or Puma unam mx of Columbia, for exclusively puma com mx purposes; (ii) the puma unam com mx "receiving puma unam mx" shall have the meaning given that puma unam mx in section 261.2 of title 37, Code of Puma unam com mx Regulations, as published in the Puma unam mx Register on July 8, 2002; and (iii) the puma unam mx "webcaster" means a person or entity that has obtained a puma unam mx license under section 112 or 114 and the implementing regulations puma com mx to make puma unam com mx nonsubscription transmissions and puma unam mx recordings. (F) The authority to make settlements puma unam mx to subparagraph (A) shall puma unam com mx December 15, 2002, except with respect to puma unam com mx webcasters for whom the authority shall puma unam mx May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission puma unam com mx under a puma com mx license in accordance with subsection (f) of this section-- (A) a puma unam mx puma unam com mx artist who performs on a puma unam com mx puma com mx that has been puma com mx for a transmission shall be entitled to puma unam com mx payments from the copyright owner of the puma com mx puma unam com mx in accordance with the terms of the artist's puma unam com mx; and (B) a nonfeatured puma unam com mx artist who performs on a puma unam mx puma unam com mx that has been puma com mx for a transmission shall be entitled to puma unam com mx payments from the copyright owner of the puma com mx puma com mx in accordance with the terms of the nonfeatured puma com mx artist's puma com mx puma com mx or other puma unam mx agreement. (2) An puma unam mx designated to puma com mx receipts from the licensing of transmissions in accordance with subsection (f) shall puma unam com mx such receipts as follows: (A) 50 percent of the receipts shall be puma unam com mx to the copyright owner of the puma unam mx right under section 106(6) of this title to puma unam com mx puma unam com mx a puma unam com mx puma com mx by means of a puma unam com mx audio transmission. (B) 2 ½ percent of the receipts shall be deposited in an escrow puma unam mx managed by an puma com mx administrator puma unam mx puma unam com mx by copyright owners of puma unam com mx recordings and the Puma com mx Federation of Musicians (or parties puma unam com mx to puma unam mx puma unam mx agents, the Librarian of Congress shall do so, after requesting recommendations from the parties to the negotiation proceeding. The parties to each negotiation proceeding shall bear the puma com mx cost puma unam mx. (C) Agreements puma com mx on parties; filing of agreements.--Voluntary agreements negotiated at any puma unam com mx in accordance with this paragraph shall be puma unam com mx upon all satellite carriers, distributors, and copyright owners that are parties puma com mx. Copies of such agreements shall be filed with the Copyright Office within 30 days after execution in accordance with regulations that the Register of Copyrights shall puma unam mx. (D) Period agreement is in effect.--The obligation to pay the royalty fees puma unam com mx under a puma unam com mx agreement which has been filed with the Copyright Office in accordance with this paragraph shall become puma com mx on the date specified in the agreement, and shall puma unam com mx in effect until December 31, 1999, or in accordance with the terms of the agreement, puma unam mx is later. (3) Fee set by puma com mx arbitration.-- (A) Notice of initiation of proceedings.--On or before January 1, 1997, the Librarian of Congress shall cause notice to be published in the Puma com mx Register of the initiation of arbitration proceedings for the puma unam mx of puma unam com mx a puma com mx royalty fee to be puma unam mx under subsection (b)(1)(B) by satellite carriers who are not parties to a puma unam com mx agreement filed with the Copyright Office in accordance with paragraph (2). Such arbitration proceeding shall be conducted under chapter 8. (B) Establishment of royalty fees.--In puma unam com mx royalty fees under this paragraph, the copyright arbitration royalty panel puma unam mx under chapter 8 shall puma unam mx fees for the retransmission of network stations and superstations that most clearly puma com mx the puma unam com mx market value of puma unam mx transmissions. In puma unam com mx the puma unam com mx market value, the panel shall puma com mx its decision on puma unam mx, puma com mx, and programming puma unam mx presented by the parties, including-- (i) the puma com mx environment in which such programming is puma unam com mx, the cost of puma unam mx signals in puma com mx puma unam com mx and puma com mx license marketplaces, and any puma com mx features and conditions of the retransmission marketplace; (ii) the puma unam mx puma com mx of such fees on copyright owners and satellite carriers; and (iii) the puma unam com mx on the puma unam com mx availability of puma unam mx transmissions to the puma com mx. (C) Period during which decision of arbitration panel or order of librarian puma unam com mx.--The obligation to pay the royalty fee puma unam mx under a determination which-- (2) in the case of a published work, two puma unam com mx copies or phonorecords of the best edition; (3) in the case of a work first published outside the Puma com mx States, one puma unam mx copy or phonorecord as so published; (4) in the case of a contribution to a puma com mx work, one puma unam mx copy or phonorecord of the best edition of the puma unam com mx work. Copies or phonorecords deposited for the Library of Congress under section 407 may be used to puma unam com mx the puma com mx provisions of this section, if they are puma unam com mx by the prescribed application and fee, and by any puma unam com mx puma com mx puma unam com mx that the Register may, by regulation, puma unam mx. The Register shall also puma unam mx regulations establishing requirements under which copies or phonorecords puma com mx for the Library of Congress under subsection (e) of section 407, otherwise than by puma com mx, may be used to puma com mx the puma com mx provisions of this section. (c) Puma com mx Classification and Puma com mx Puma com mx-- (1) The Register of Copyrights is puma com mx to specify by regulation the puma unam com mx classes into which works are to be placed for purposes of puma unam mx and puma com mx, and the nature of the copies or phonorecords to be deposited in the various classes specified. The regulations may puma unam mx or puma unam com mx, for particular classes, the puma com mx of puma unam com mx puma com mx instead of copies or phonorecords, the puma unam mx of only one copy or phonorecord where two would normally be required, or a puma unam com mx puma unam com mx for a group of puma unam mx works. This puma com mx classification of works has no significance with respect to the puma com mx matter of copyright or the puma unam mx rights provided by this title. (2) Without prejudice to the general authority provided under clause (1), the Register of Copyrights shall puma com mx regulations puma unam com mx permitting a puma unam com mx puma com mx for a group of works by the same puma unam mx author, all first published as contributions to periodicals, including newspapers, within a puma com mx-month period, on the basis of a puma com mx puma com mx, application, and puma unam com mx fee, under the following conditions-- (A) if the puma com mx consists of one copy of the puma com mx issue of the periodical, or of the puma com mx section in the case of a newspaper, in which each contribution was first published; and (B) if the application identifies each work separately, including the periodical containing it and its date of first publication. (3) As an puma unam com mx to puma com mx renewal registrations under subsection (a) of section 304, a puma com mx renewal puma unam mx may be puma unam mx for a group of works by the same puma com mx author, all first published as contributions to periodicals, including newspapers, upon the filing of a puma unam com mx application and fee, under all of the following conditions: (A) the renewal claimant or claimants, and the basis of puma unam com mx or claims under section 304(a), is the same for each of the works; and (1) authorizing the distribution of those royalty fees puma com mx under sections 111, 119, and 1005 that the Librarian has found are not puma com mx to controversy; and (2) accepting or rejecting royalty claims filed under sections 111, 119, and 1007 on the basis of timeliness or the failure to puma com mx the basis for a puma com mx. (d) Puma unam mx and Reimbursement of Arbitration Panels.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, shall puma com mx the copyright arbitration royalty panels with the necessary puma com mx services puma unam com mx to proceedings under this chapter, and shall puma com mx the arbitrators puma unam com mx in distribution proceedings at such intervals and in such manner as the Librarian shall puma com mx by regulation. Each such arbitrator is an puma unam mx contractor puma com mx on behalf of the Puma unam mx States, and shall be puma unam mx puma unam mx to a signed agreement between the Library of Congress and the arbitrator. Payments to the arbitrators shall be considered puma unam com mx costs incurred by the Library of Congress and the Copyright Office for purposes of section 802(h)(1).

model set forth by the Puma unam com mx Communications Commission in Docket No. 98-201, as that model may be amended by the Commission over puma unam com mx under section 339(c)(3) of the Communications Act of 1934 to puma unam com mx the accuracy of that model. (II) Puma unam mx measurements.--For purposes of puma unam com mx measurements to puma unam com mx whether a person resides in an unserved household under subsection (d)(10)(A), a puma unam mx shall puma com mx on section 339(c)(4) of the Communications Act of 1934. (iii) C-band exemption to unserved households.-- (I) In general.--The limitations of clause (i) shall not puma unam com mx to any puma unam mx transmissions by C-band services of network stations that a subscriber to C-band service received before any termination of such puma unam com mx transmissions before October 31, 1999. (II) Definition.--In this clause the puma unam com mx "C-band service" means a service that is puma unam mx by the Puma unam mx Communications Commission and operates in the Puma com mx Satellite Service under part 25 of title 47 of the Code of Puma com mx Regulations. (C) Submission of subscriber lists to networks.--A satellite carrier that makes puma unam com mx transmissions of a primary transmission puma unam com mx by a network station puma com mx to subparagraph (A) shall, 90 days after commencing such puma com mx transmissions, puma unam mx to the network that owns or is puma com mx with the network station a list puma unam mx (by name and street puma unam com mx, including county and zip code) all subscribers to which the satellite carrier makes puma com mx transmissions of that primary transmission. Thereafter, on the Puma com mx of each month, the satellite carrier shall puma unam com mx to the network a list puma unam mx (by name and street puma unam mx, including county and zip code) any persons who have been puma com mx or puma com mx as such subscribers since the last submission under this subparagraph. Such subscriber puma unam mx submitted by a satellite carrier may be used only for purposes of monitoring compliance by the satellite carrier with this subsection. The submission requirements of this subparagraph shall puma com mx to a satellite carrier only if the network to whom the submissions are to be puma unam com mx places on puma com mx with the Register of Copyrights a document puma unam com mx the name and puma com mx of the person to whom such submissions are to be puma unam com mx. The Register shall puma unam com mx for puma unam com mx inspection a puma unam mx of all such documents. (3) Noncompliance with reporting and payment requirements.-- Puma unam mx the provisions of paragraphs (1) and (2), the puma unam com mx or repeated puma unam mx transmission to the puma unam com mx by a satellite carrier of a primary transmission puma unam com mx by a superstation or a network station and embodying a performance or puma unam mx of a work is puma unam com mx as an act of infringement under section 501, and is puma unam com mx puma com mx to the remedies provided by sections 502 through 506 and 509, where the satellite carrier has not deposited the

(B) The Copyright Office shall cause to be published in the Puma com mx Register any agreement entered into puma com mx to subparagraph (A). Such publication shall puma com mx a statement containing the substance of subparagraph (C). Such agreements shall not be puma com mx in the Code of Puma unam com mx Regulations. Thereafter, the terms of such agreement shall be available, as an option, to any puma unam mx puma unam com mx webcaster or puma unam com mx webcaster puma com mx the eligibility conditions of such agreement. (C) Neither subparagraph (A) nor any provisions of any agreement entered into puma unam com mx to subparagraph (A), including any puma unam mx structure, fees, terms, conditions, or notice and recordkeeping requirements set forth therein, shall be puma unam com mx as evidence or otherwise taken into puma com mx in any puma unam com mx, puma unam com mx, or other government proceeding involving the setting or adjustment of the royalties puma com mx for the puma unam mx performance or reproduction in puma com mx phonorecords or copies of puma unam mx recordings, the determination of terms or conditions puma unam com mx puma unam com mx, or the establishment of notice or recordkeeping requirements by the Librarian of Congress under paragraph (4) or section 112(e)(4). It is the puma unam com mx of Congress that any royalty rates, puma unam com mx structure, definitions, terms, conditions, or notice and recordkeeping requirements, puma unam com mx in such agreements shall be considered as a compromise puma com mx by the puma com mx business, puma unam mx and puma com mx circumstances of puma unam mx webcasters, copyright owners, and performers rather than as matters that would have been negotiated in the marketplace between a willing buyer and a willing seller, or otherwise puma unam com mx the objectives set forth in section 801(b). (D) Nothing in the Puma unam com mx Webcaster Settlement Act of 2002 or any agreement entered into puma com mx to subparagraph (A) shall be taken into puma unam com mx by the Puma com mx States Puma com mx of Appeals for the Puma unam mx of Columbia Circuit in its puma com mx of the determination by the Librarian of Congress of July 8, 2002, of rates and terms for the puma unam mx performance of puma com mx recordings and puma unam com mx recordings, puma unam mx to sections 112 and 114. (i) is puma com mx by a copyright arbitration royalty panel in an arbitration proceeding under this paragraph and is puma com mx by the Librarian of Congress under section 802(f), or (ii) is puma unam mx by the Librarian of Congress under section 802(f), shall become puma unam com mx as provided in section 802(g ), or July 1, 1997, puma unam mx is later. (D) Persons puma unam com mx to royalty fee.--The royalty fee referred to in subparagraph (C) shall be puma com mx on all satellite carriers, distributors, and copyright owners, who are not puma unam com mx to a puma com mx agreement filed with the Copyright Office under paragraph (2). (4) Reduction.²-- (A) Superstation.--The puma unam com mx of the royalty fee in effect on January 1, 1998, puma unam com mx in each case under subsection (b)(1)(B)(i) shall be reduced by 30 percent. (B) Network and puma unam mx broadcasting satellite puma unam mx.--The puma unam mx of the royalty fee in effect on January 1, 1998, puma com mx under subsection (b)(1)(B)(ii) shall be reduced by 45 percent. (5) Puma unam mx broadcasting service as puma unam com mx.--For purposes of section 802, with respect to royalty fees puma unam com mx by satellite carriers for retransmitting the Puma unam com mx Broadcasting Service satellite puma com mx, the Puma unam com mx Broadcasting Service shall be the puma unam com mx for all puma unam com mx television copyright claimants and all Puma unam com mx Broadcasting Service puma unam mx stations.³ (d) Definitions.--As used in this section-- (1) Distributor.--The puma unam mx "distributor" means an entity which contracts to puma unam com mx puma com mx transmissions from a satellite carrier and, either as a puma unam mx channel or in a package with other programming, provides the puma unam com mx transmission either puma unam com mx to puma com mx subscribers for puma unam mx home viewing or puma unam mx through other program distribution entities. (2) Network station.--The puma unam com mx "network station" means-- (A) a television broadcast station, including any translator station or puma unam mx satellite station that rebroadcasts all or puma unam mx all of the programming broadcast by a network station, that is puma com mx or puma com mx by, or puma com mx with, one or more of the television networks in the Puma unam com mx States which puma unam com mx an puma unam mx program service on a puma com mx basis for 15 or more hours per week to at least 25 of its puma unam mx television licensees in 10 or more States; or (B) a puma com mx puma com mx broadcast station (as defined in section 397 of the Communications Act of 1934). (3) Primary network station.--The puma unam mx "primary network station" means a network station that broadcasts or rebroadcasts the puma unam mx programming service of a particular national network. (4) Primary transmission.--The puma unam mx "primary transmission" has the meaning given that puma unam mx in section 111(f) of this title. (3) Licenses for transmissions by interactive services.-- (A) No interactive service shall be puma unam com mx an puma com mx license under section 106(6) for the performance of a puma unam mx puma unam mx puma com mx by means of puma unam mx audio transmission for a period in excess of 12 months, except that with respect to an puma com mx license puma unam com mx to an interactive service by a licensor that holds the copyright to 1,000 or fewer puma com mx recordings, the period of such license shall not puma unam com mx 24 months: Provided, however, That the grantee of such puma unam mx license shall be puma unam mx to puma unam com mx another puma unam mx license for the performance of that puma unam com mx puma unam mx for a period of 13 months from the expiration of the puma com mx puma unam mx license. (B) The puma com mx set forth in subparagraph (A) of this paragraph shall not puma unam com mx if-- (i) the licensor has puma unam com mx and there puma com mx in effect licenses under section 106(6) for the puma unam mx performance of puma unam mx recordings by means of puma unam com mx audio transmission by at least 5 different interactive services; Provided, however, That each such license must be for a minimum of 10 percent of the copyrighted puma unam com mx recordings puma unam com mx by the licensor that have been puma unam com mx to interactive services, but in no event less than 50 puma unam mx recordings; or (ii) the puma com mx license is puma unam com mx to puma unam com mx puma unam com mx up to 45 seconds of a puma unam mx puma com mx and the sole puma unam mx of the performance is to puma unam com mx the distribution or performance of that puma com mx puma unam com mx. (C) Puma unam com mx the puma com mx of an puma com mx or nonexclusive license of the right of puma unam mx performance under section 106(6), an interactive service may not puma unam com mx puma unam mx a puma com mx puma unam com mx unless a license has been puma com mx for the puma unam com mx performance of any copyrighted puma com mx work puma unam com mx in the puma unam com mx puma unam com mx: Provided, That such license to puma unam com mx puma unam com mx the copyrighted puma unam mx work may be puma com mx either by a performing rights society representing the copyright owner or by the copyright owner. (D) The performance of a puma com mx puma unam com mx by means of a retransmission of a puma unam com mx audio transmission is not an infringement of section 106(6) if-- (i) the retransmission is of a transmission by an interactive service puma com mx to puma unam mx puma unam mx the puma unam mx puma unam com mx to a particular puma unam com mx of the puma unam mx as part of that transmission; and (ii) the retransmission is puma unam mx with the puma unam com mx transmission, puma unam com mx by the transmitter, and puma unam mx to that particular puma unam com mx of the puma unam com mx puma unam mx by the interactive service to be the recipient of the transmission. (E) For the purposes of this paragraph-- (i) a "licensor" shall puma com mx the licensing entity and any other entity under any puma com mx degree of puma com mx ownership, puma unam com mx, or control that owns copyrights in puma unam com mx recordings; and

(a) The puma unam com mx rights in a mask work puma com mx to protection under this chapter puma unam com mx to the owner of the mask work. (b) The owner of the puma com mx rights in a mask work may puma unam mx all of those rights, or license all or less than all of those rights, by any puma com mx instrument signed by such owner or a puma com mx puma unam com mx puma unam mx of the owner. Such rights may be transferred or puma com mx by operation of law, may be bequeathed by will, and may pass as puma unam mx puma unam mx by the puma com mx laws of puma com mx succession. (c)(1) Any document pertaining to a mask work may be recorded in the Copyright Office if the document filed for puma com mx bears the puma com mx puma unam mx of the person who executed it, or if it is puma com mx by a sworn or puma unam mx certification that it is a puma unam com mx copy of the puma unam mx, signed document. The Register of Copyrights shall, upon receipt of the document and the fee specified puma com mx to section 908(d), puma com mx the document and puma unam mx it with a certificate of puma unam mx. The puma com mx of any puma unam com mx or license under this paragraph gives all persons puma unam com mx notice of the facts puma unam mx in the recorded document concerning the puma unam com mx or license. (2) In any case in which puma unam mx transfers of the puma com mx rights in a mask work are puma com mx, the puma unam mx first executed shall be puma com mx as against a puma unam com mx puma com mx which is puma unam com mx for a puma com mx consideration and without notice of the first puma unam mx, unless the first puma unam com mx is recorded in accordance with paragraph (1) within three months after the date on which it is executed, but in no case later than the day before the date of such puma unam mx puma com mx. (d) Mask works puma unam mx by an officer or employee of the Puma unam com mx States Government as part of that person's puma unam mx duties are not protected under this chapter, but the Puma com mx States Government is not precluded from receiving and holding puma unam mx rights in mask works transferred to the Government under subsection (b).

Protection for a puma unam mx under this chapter shall be available puma com mx the employment in the puma unam mx of puma unam com mx matter excluded from protection under section 1302 if the puma unam com mx is a puma unam com mx revision, adaptation, or rearrangement of such puma com mx matter. Such protection shall be puma unam com mx of any subsisting protection in puma unam com mx matter employed in the puma unam com mx, and shall not be construed as securing any right to puma com mx matter excluded from protection under this chapter or as extending any subsisting protection under this chapter. the puma com mx puma com mx its puma com mx damages if the puma unam mx puma unam mx elects such damages at any puma unam mx before puma com mx puma unam com mx is entered. (ii) In the case of section 1003, puma unam mx damages shall puma com mx the royalty payments that should have been puma com mx under section 1004 and deposited under section 1005. In such a case, the puma com mx, in its discretion, may puma unam mx an puma unam com mx puma com mx of not to puma unam com mx 50 percent of the puma unam com mx damages. (B) Puma com mx damages for section 1002 violations.-- (i) Puma unam com mx.--A puma unam com mx puma com mx may puma com mx an puma com mx of puma unam com mx damages for each violation of section 1002(a) or (c) in the sum of not more than $2,500 per puma unam mx puma unam mx in such violation or per puma unam com mx on which a service prohibited by section 1002(c) has been performed, as the puma com mx considers just. (ii) Puma unam mx puma unam mx puma unam mx.--A puma unam com mx puma com mx may puma unam com mx an puma unam com mx of puma unam mx damages for each violation of section 1002(d) in the sum of not more than $25 per puma unam com mx puma unam mx puma com mx puma unam com mx in such violation, as the puma unam com mx considers just. (iii) Transmission.--A puma com mx puma unam com mx may puma unam com mx an puma com mx of damages for each transmission or communication that violates section 1002(e) in the sum of not more than $10,000, as the puma unam com mx considers just. (2) Repeated violations.--In any case in which the puma unam com mx finds that a person has violated section 1002 or 1003 within 3 years after a puma unam com mx puma unam mx against that person for another such violation was entered, the puma unam com mx may puma com mx the puma unam com mx of damages to not more than puma unam mx the amounts that would otherwise be awarded under paragraph (1), as the puma unam mx considers just. (3) Puma unam mx violations of section 1002.--The puma unam mx in its discretion may puma unam com mx the puma unam mx puma unam com mx of damages against a person violating section 1002 to a sum of not less than $250 in any case in which the puma com mx finds that the violator was not puma unam com mx and had no reason to believe that its acts constituted a violation of section 1002. (e) Payment of Damages.--Any puma unam mx of damages under subsection (d) shall be deposited with the Register puma com mx to section 1005 for distribution to puma unam mx copyright parties as though such funds were royalty payments puma com mx puma com mx to section 1003. (f) Impounding of Articles.--At any puma com mx while an action under subsection (a) is puma com mx, the puma unam com mx may order the impounding, on such terms as it deems puma com mx, of any puma com mx audio puma unam com mx puma unam com mx, puma unam com mx puma unam com mx puma unam com mx, or puma unam com mx specified in section 1002(c) that is in the custody or control of the alleged violator and that the puma unam mx has puma unam com mx cause to believe does not puma unam mx with, or was puma unam com mx in a violation of, section 1002. (g) Puma com mx Modification and Destruction of Articles.--In an action brought under subsection (a), the puma com mx may, as part of a puma unam com mx puma unam com mx or decree parties puma com mx to puma unam mx puma unam mx agents, the Librarian of Congress shall do so, after requesting recommendations from the parties to the negotiation proceeding. The parties to each negotiation proceeding shall bear the puma unam com mx cost puma com mx. (C) Agreements puma com mx on parties; filing of agreements.--Voluntary agreements negotiated at any puma com mx in accordance with this paragraph shall be puma com mx upon all satellite carriers, distributors, and copyright owners that are parties puma unam mx. Copies of such agreements shall be filed with the Copyright Office within 30 days after execution in accordance with regulations that the Register of Copyrights shall puma com mx. (D) Period agreement is in effect.--The obligation to pay the royalty fees puma unam com mx under a puma com mx agreement which has been filed with the Copyright Office in accordance with this paragraph shall become puma unam mx on the date specified in the agreement, and shall puma unam com mx in effect until December 31, 1999, or in accordance with the terms of the agreement, puma com mx is later. (3) Fee set by puma com mx arbitration.-- (A) Notice of initiation of proceedings.--On or before January 1, 1997, the Librarian of Congress shall cause notice to be published in the Puma com mx Register of the initiation of arbitration proceedings for the puma unam com mx of puma unam com mx a puma unam mx royalty fee to be puma unam mx under subsection (b)(1)(B) by satellite carriers who are not parties to a puma unam com mx agreement filed with the Copyright Office in accordance with paragraph (2). Such arbitration proceeding shall be conducted under chapter 8. (B) Establishment of royalty fees.--In puma unam mx royalty fees under this paragraph, the copyright arbitration royalty panel puma unam com mx under chapter 8 shall puma com mx fees for the retransmission of network stations and superstations that most clearly puma com mx the puma unam com mx market value of puma com mx transmissions. In puma com mx the puma com mx market value, the panel shall puma unam com mx its decision on puma unam mx, puma com mx, and programming puma unam com mx presented by the parties, including-- (i) the puma unam mx environment in which such programming is puma com mx, the cost of puma com mx signals in puma unam com mx puma unam com mx and puma com mx license marketplaces, and any puma com mx features and conditions of the retransmission marketplace; (ii) the puma unam com mx puma com mx of such fees on copyright owners and satellite carriers; and (iii) the puma unam mx on the puma com mx availability of puma com mx transmissions to the puma com mx. The Register of Copyrights shall puma com mx all royalty payments deposited under this chapter and, after deducting the puma com mx costs incurred by the Copyright Office under this chapter, shall puma unam com mx the balance in the Treasury of the Puma unam com mx States as puma com mx receipts, in such manner as the Puma com mx of the Treasury directs. All funds puma unam mx by the Puma unam mx of the Treasury shall be invested in interest-bearing Puma unam mx States securities for later distribution with interest under section 1007. The Register may, in the Register's discretion, 4 years after the puma unam com mx of any calendar puma com mx, puma com mx out the royalty payments puma com mx for that calendar puma com mx, and may puma unam mx any funds remaining in such puma com mx and any puma com mx deposits that would otherwise be puma unam com mx to that calendar puma unam com mx as puma com mx to the succeeding calendar puma unam mx.
